IMPORTANT -- PLEASE READ: Following are the Terms of Service (“Terms”) for the Xerox Community Forum (“Forum”). Your use of the Forum is governed by:

1. these Terms;

These Terms describe the proper kinds of conduct and prohibited uses of the Forum. These Terms are not exhaustive, and Xerox reserves the right to modify them at any time effective upon posting of the modified terms on the Forum. By registering as a user or using the Forum, you agree to abide by these Terms as modified from time to time. Any violation of these Terms may result in the suspension or termination of your right to access the Forum.

Xerox Community Manager

Purpose 

The Forum is a peer-to-peer support channel for Xerox products and services.   We welcome all users as long as they observe the community rules of conduct set forth in these Terms.

The Forum is not intended to provide a means for obtaining Xerox-provided support and does not replace the standard processes for requesting onsite service. When contacting Xerox for support, you may be required to provide proof of that you have a service contract or other product entitlement prior to receiving support or service.

Conduct

You agree to use the Forum, Content and Software (whether provided by us or others) in a manner consistent with all applicable laws and regulations.

You may not use your registration membership (or allow anyone else to use your registration membership) to upload, post, email, distribute, transmit, link, solicit or otherwise make available any Content or use the Forum in any manner that is:

1. abusive, vulgar, obscene, harmful to minors, defamatory, slanderous, gratuitously violent pornographic, indecent, lewd, libelous, invasive of another's privacy, hateful or fraudulent. This includes language, information, or images;
2. threatening, defamatory or abusive, either between forum members or directed towards any individual, including a moderator, or a Xerox employee or manager;
3. bigoted, or racially offensive comments;
4. a political or religious statement or commentary;
5. spam and/or other self-serving material.

In addition, you may not, through your use of the Forum:

1. provide material support or resources (or conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
2. promote illegal activity or discusses illegal activities with the intent to commit them including any message that solicits or promotes the use of an illegal substance advocates or solicits violence or the violation of any local, state, national or international law or the rights of any third party;
3. publish any material that infringes someone else's patent, trademark, trade secret, copyright or other intellectual property or other rights or that you don't have the right to transmit under law  or under contractual or fiduciary relationships (such as nondisclosure agreements) or remove any proprietary notices or labels on the Content;
4. intentionally violate any other applicable law or regulation while accessing and using the Forum;
5. interfere in any way with the operation of the Forum or with a fellow user’s message box, including but not limited to mail or "post" bombing, news bombing, other flooding techniques or deliberate attempts to overload a system and broadcast attacks;
6. evade bans or suspensions or otherwise disregard directions from moderators or administrators;
7. attempt to disable, bypass, modify, defeat or otherwise circumvent any of the digital rights management or other security related tools incorporated into the software;
8. reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Forum or advertise, post or publish promotional materials or other forms of solicitation to the Forum;
9. make off-topic comments not related to Xerox products and services;
10. duplicate posts, spam messages, or posts repeated excessively on one or more boards;
11. post personal messages designed to evade profanity or other filters;
12. post personal, private information such as social security numbers, email addresses or other contact information that is not your own, including, but not limited to a Xerox employee’s email addresses;
13. hyperlink to sites that violate any of the forum guidelines;
14. “Rant,” “slam,” or makes legal threats against Xerox or another company or competitor;
15. post content that impersonates another person or affiliation with an entity, including, but not limited to, Xerox.

Moderators may at any time and without prior notice remove any posted message or thread, delete words that violate these guidelines from posted messages, remove any content deemed irrelevant, inappropriate or overly self-promotional or ban your account for violating the above reasonable provisions.

Please remember that you are responsible for all statements made and acts that occur through the use of your username and password. If you recognize any violation of these guidelines, please notify us by using the “report abuse to moderator” feature in the Options menu of the message, or by contacting us directly at: Xerox.Support.Community.Team@xerox.com

Copyright Infringement

If you believe that work belonging to you has been copied onto the Xerox Community Forum without your permission, please notify us by sending a written notification of claimed infringement to:

Your notification must include:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Registration

You are not obligated to register in order to access the Community Forum and read the message boards. However, registration (via provision of a valid email address, screen name and password) and login are required in order to post to the message boards and adjust user settings. Xerox will handle all information received from you in accordance with the Xerox Privacy Policy.

When you register, you will also be asked to enter your personal information. Please keep in mind when choosing a screen name and filling out your profile that whenever you post to a message board your screen name, and a link to your profile and online status, will automatically appear with your post. (Note: Options to hide certain fields are available in the user profile). 

User Profile Information

We may refuse to grant you, and you may not use, a screen name or email address that is already being used by someone else, that impersonates another person, that belongs to another person (without that person’s prior consent), that violates the intellectual property or other rights of any person, that is vulgar or otherwise offensive, or that we reject for any other reason, at our sole discretion.

In consideration of your use of the Xerox Community Forum you agree that all information provided in your profile is accurate, true, current, and complete. Xerox may terminate your account if any of the information provided is found to be inaccurate, false, out of date, or incomplete. Unless you are participating in an area of the Forum that requires or encourages anonymity, we encourage you to use your real name.

Xerox reserves the right, to immediately terminate or suspend your use of the Forum, any associated email address, and access to the Forum at any time for any reason and without notice to you in its sole discretion. Cause for such termination, suspension or change shall include, but not be limited to, (a) breaches or violations of these Terms or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Sites (or any part thereof,) (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, and/or (g) engagement by you in fraudulent or illegal activities. You agree that all terminations and suspensions for cause shall be made in Xerox's sole discretion and that Xerox shall not be liable to you or any third party for any termination or suspension of your use of the Forum.

Member-Generated Content

The content found in the Forum comes from a variety of sources, primarily from community members. Xerox makes no claims or representations as to the accuracy, completeness, or truth of any material submitted or found in the discussion areas. Xerox is not liable for any website links posted within the discussion areas; website links posted in the discussion areas may link to sites not administered or under the control of Xerox and users must open such links at their own risk. Xerox is not liable for any errors or delays in the content or transmission of postings on the site. Remember that you are responsible for your own decisions to act upon the information provided by community members. Xerox makes no guaranty of the confidentiality or privacy of any communication or information transmitted on the site, or any web-site linked to the site or otherwise in connection with the services. Xerox  will not be liable for the privacy of e-mail addresses, registration and identification information, confidential or trade-secret information.

Unauthorized Use

If your user identification or password(s) is compromised, or if you become aware of any unauthorized use of your account or other breach of security, you are responsible for promptly notifying us. You can notify us by sending an email to: Xerox.Support.Community.Team@xerox.com.

Age

You must be 13 years of age or older to access the Forum. By using the Forum, you represent that you are at least 13 years old. Persons who are at least 13 years of age but under the age of 18 may only use the Forum with legal parental or guardian consent. Accordingly, you agree that you are at least 18 years of age or older or possess legal parental or guardian consent and are fully able and competent to enter into the terms, conditions, representations and warranties set forth in the Terms; otherwise, please exit the Forum.

Language

The language of the Xerox Community Forum is English.

Modifications

Xerox may change or modify the Terms from time-to-time without notice other than posting the amended Terms on the Forum. The amended Terms will automatically be effective when posted on our Forum. Your continued use of the Forum after such changes shall constitute your consent to such changes.

Xerox reserves the right to change, modify or discontinue, temporarily or permanently, the  Forum (or any portion thereof), including any and all content contained on the Forum, at any time without notice. You agree that Xerox shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Forum (or any portion thereof).

Disclaimer of Warranties

1. YOUR USE OF THE FORUM, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN THE FORUMS, ANY FORUM-RELATED SERVICE OR SOFTWARE THAT IS PROVIDED TO YOU, IS AT YOUR SOLE RISK. THE FORUM, INCLUDING ANY CONTENT, OR INFORMATION CONTAINED WITH THE FORUMS AND ANY FORUM-RELATED SERVICE, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. XEROX AND ITS RESPECTIVE OFFICERS, AGENTS, REPRESENTATIVES, AND EMPLOYEES MAKE NO WARRANTY THAT (i) THE FORUM WILL MEET YOUR REQUIREMENTS, (ii) MATERIALS, OR CONTENT AVAILABLE FOR DOWNLOAD FROM THE FORUM ARE FREE OF INFECTION OR VIRUSES, WORMS, TROJAN HORSES, OR OTHER CODE THAT MANIFESTS CONTAMINATING OR DESTRUCTIVE PROPERTIES; (iii) THE FORUM WILL BE UNINTERRUPTED, TIMELY, SECURE (INCLUDING FREE FROM UNAUTHORIZED ACCESS), PROVIDE CONTINUOUS STORAGE OR ACCESS, OR ERROR-FREE, (iv) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE FORUM WILL BE ACCURATE, COMPLETE OR RELIABLE, (v) ANY ERRORS IN THE FORUM OR SOFTWARE WILL BE CORRECTED.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE FORUM AND/OR FORUM-RELATED SERVICES IS TO STOP USING THE FORUM AND/OR THOSE SERVICES.

APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY, IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. Indemnification

To the extent permitted under applicable law, you agree to indemnify, defend and hold harmless Xerox and its subsidiaries, affiliates, officers, agents, and employees, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, made by any third-party due to or arising out of your use of the Forum or any content you submit, post or upload to or transmit through the Forum, your connection to the Forum, your violation of these Terms, or your violation of any law or the rights of another. These obligations will survive any termination of your relationship with Xerox or your use of the Forum. Xerox reserves the right to assume the defense and control of any matter subject to indemnification by you, in which event you will cooperate with Xerox in asserting any available defenses.

Governing Law and Venue

By accessing or using the Forum, in any way you are agreeing to comply with these Terms including any documents, policies and guidelines incorporated by reference. These Terms, and related documents set forth herein constitute the entire agreement between you and Xerox and governs your use of the Xerox Community Forum superseding any prior agreements between you and Xerox.

Failure to comply with these Terms may result in account revocation and other legal action. The laws of the State of New York, U.S.A., shall govern the Terms and the relationship between you and Xerox, without regard to conflict of law provisions. You and Xerox agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Monroe, New York, U.S.A.

The Terms do not alter in any way the terms or conditions of any of these other written or online terms and conditions or agreements you may have or will have with Xerox, including any other website terms of use with a Xerox affiliate. To the extent that there is any conflict between these Terms and any terms and conditions or agreements relating to services you have purchased or online tools you use or to which you subscribe, those other terms and conditions or agreements will govern.

You agree that all terminations and suspensions for cause shall be made in Xerox's sole discretion and that Xerox shall not be liable to you or any third party for any termination or suspension of your use of the Forum.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE FORUM AND/OR FORUM-RELATED SERVICES IS TO STOP USING THE FORUM AND/OR THOSE SERVICES.

Indemnification

To the extent permitted under applicable law, you agree to indemnify, defend and hold harmless Xerox and its subsidiaries, affiliates, officers, agents, and employees, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, made by any third-party due to or arising out of your use of the Forum or any content you submit, post or upload to or transmit through the Forum, your connection to the Forum, your violation of these Terms, or your violation of any law or the rights of another. These obligations will survive any termination of your relationship with Xerox or your use of the Forum. Xerox reserves the right to assume the defense and control of any matter subject to indemnification by you, in which event you will cooperate with Xerox in asserting any available defenses.

Governing Law and Venue

By accessing or using the Forum, in any way you are agreeing to comply with these Terms including any documents, policies and guidelines incorporated by reference. These Terms, and related documents set forth herein constitute the entire agreement between you and Xerox and governs your use of the Xerox Community Forum superseding any prior agreements between you and Xerox.

Failure to comply with these Terms may result in account revocation and other legal action. The laws of the State of New York, U.S.A., shall govern the Terms and the relationship between you and Xerox, without regard to conflict of law provisions. You and Xerox agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Monroe, New York, U.S.A.

The Terms do not alter in any way the terms or conditions of any of these other written or online terms and conditions or agreements you may have or will have with Xerox, including any other website terms of use with a Xerox affiliate. To the extent that there is any conflict between these Terms and any terms and conditions or agreements relating to services you have purchased or online tools you use or to which you subscribe, those other terms and conditions or agreements will govern.
